Federal DOT Rules Override State Law

DOT Testing & Cannabis: What State Legalization Does Not Change

State cannabis protections never apply to DOT-regulated safety-sensitive employees. Under 49 CFR Part 40, marijuana remains a federally prohibited Schedule I substance for every DOT testing program — regardless of how legal the state has made adult or medical use.

The Federal Floor

  • 49 CFR Part 40 governs all DOT-regulated drug and alcohol testing. THC is on the mandatory 5-panel test.
  • A DOT medical review officer (MRO) cannot verify a positive result as negative based on a state medical-marijuana recommendation.
  • A positive DOT test removes the employee from safety-sensitive duty until they complete the return-to-duty process with a substance abuse professional.
  • CBD use does not excuse a positive THC test. The DOT explicitly warns drivers that CBD products may contain enough THC to trigger a positive.
  • State statutes legalizing cannabis (CA AB 2188, NY Labor Law § 201-d, NJ CREAMMA, etc.) all carry express DOT/federal carve-outs.
