An Evidential Breath Testing device (EBT) is the only approved instrument for DOT confirmation alcohol testing under 49 CFR Part 40. EBTs must be on the NHTSA Conforming Products List (CPL) and must: print the results, assign a unique sequential test number to each test, and distinguish between an initial (screening) and confirmation test. Non-evidential screening devices (like saliva tests) may be used for the initial screen, but only an EBT can provide a confirmed result. Devices must be calibrated according to manufacturer specifications.
