Under 49 CFR 382.303, post-accident testing is required when a CDL driver is involved in an accident resulting in: (1) a fatality, (2) bodily injury requiring off-site medical treatment and the driver received a citation, or (3) a disabling vehicle that must be towed and the driver received a citation. The alcohol test must be administered within 2 hours (or documented why not) and absolutely within 8 hours. The drug test must be completed within 32 hours. If either window is missed, the employer must document the reasons and maintain the record. Drivers must remain readily available for testing or the refusal is treated as a positive result.
